The WTO/International Trade and Customs Law Group at Luthra & Luthra represents exporters, importers and domestic manufacturers in various trade remedial cases in India and other foreign jurisdictions. We have represented various exporters, importers and users across several industries including chemicals, rubber, paper, pharmaceuticals, steel, high technology goods in antidumping, safeguards and countervailing proceedings before authorities including the Directorate General of Antidumping, Directorate General of Safeguards, Customs, Excise and Service Tax Appellate Tribunal, High Court, Supreme Court and the European Commission. We have also advised Indian exporters on anti-circumvention investigations in other jurisdictions.
The Firm is also frequently called
upon to render advice to various organisations such as
the Indian Ministry of Commerce, the Planning Commission
of India, and UNCTAD on WTO policy matters. We have
inter alia undertaken studies and prepared policy
material on WTO compatibility of border measures taken
by certain WTO Member against Indian exports, pricing
policies including “dual pricing” on natural resources
and natural resources based products, Mode 4 offers and
QRP/LRP procedures, Disciplines on domestic regulation
pursuant to GATS Article VI:4, India’s position on
emerging disciplines on Fisheries subsidies, structuring
an expedited mechanism to address non-tariff barriers
and reviewing IP commitments in FTAs entered into by
India.
The Group has extensive experience
in the area of Customs laws as well as the Foreign Trade
Policy. We have advised clients from diverse sectors and
industries on matters related to customs laws and
procedures. We regularly represents importers and
exporters before the Indian Ministry of Finance on
tariff concessions, issues relating to tariff
classifications, customs valuation and also matters
relating to customs enforcement. We also represent
clients in matters related to Customs as well as Foreign
Trade Policy before judicial and quasi-judicial
authorities, including the Customs, Excise, Service Tax
Appellate Tribunal (CESTAT), Authority on Advance
Rulings and Settlement Commission.
